Please read these Terms & Conditions carefully before using the website or purchasing any service or product. Accessing and using the website implies unconditional acceptance of these terms.

1. Definitions

"Website": the website diatrofologosmou.gr and all of its subpages.

"Provider" / "We" / "Us": the sole proprietorship that operates the Website and provides the Services, based in Greece.

"User" / "You": any natural or legal person who visits the Website and/or purchases Services or Products.

"Services": the nutrition guidance, counseling, and meal-plan design services offered through the Website, whether in-person or remote.

"Products": digital products (ebooks, nutrition programs) or physical products offered for sale through the Website.

"Account": the personal account created by the User on the Website.

"Agreement": the contract for the provision of Services or sale of Products concluded between the Provider and the User through the Website.

2. Introduction & Scope

These Terms & Conditions govern the relationship between the Provider and every User of the Website. They cover the use of the Website, the purchase of Services and Products, the creation and use of an Account, and any other interaction with the Website.

By accessing or using the Website, you confirm that you have read, understood, and unconditionally accept these Terms. If you disagree with any term, please do not use the Website.

These Terms apply in conjunction with the Privacy Policy and the Cookie Policy, which form an integral part hereof.

4. Website Use

The User undertakes to use the Website in accordance with applicable law, accepted ethical standards, and these Terms.

The following are expressly prohibited: (a) using the Website for illegal purposes; (b) copying, reproducing, modifying, or republishing content without written permission; (c) attempting unauthorized access to data or systems; (d) using automated means (bots, scrapers) to collect data; (e) posting illegal, offensive, or misleading content.

The Provider reserves the right to restrict or prohibit access to any User who violates these Terms, without prior notice.

5. Intellectual Property

All content on the Website, including but not limited to texts, images, graphics, logos, designs, videos, software, and databases, constitutes the intellectual property of the Provider or third-party rights holders and is protected by Greek, EU, and international intellectual property law.

Reproduction, republication, modification, distribution, or exploitation of any content without prior written permission of the Provider is prohibited, except where expressly permitted (e.g., digital products for personal use).

Trademarks, trade names, and logos appearing on the Website belong to the Provider or third parties. Their use without permission is prohibited.

6. User Account

To purchase Services or Products or to access certain features, creation of an Account may be required. The User must provide accurate, complete, and up-to-date information.

The User is solely responsible for safeguarding their login credentials (email and password) and for all actions taken through their Account. Any unauthorized use must be reported immediately to the Provider.

The Provider reserves the right to suspend or delete Accounts that violate these Terms, without prior notice.

7. Nutrition Services

The Services provided consist of nutritional assessment, personalized meal-plan design, counseling, and progress monitoring. Services are provided in-person and/or remotely (online), as described in each program.

The User acknowledges that the success of any nutrition program depends significantly on their personal adherence, effort, and consistency. The Provider does not guarantee specific results.

8. Medical Disclaimer

The Services provided do not constitute medical diagnosis, treatment, or a substitute for medical care. The Provider is not a physician, and the advice provided is strictly nutritional in nature.

The User must inform the Provider of any medical conditions, allergies, intolerances, or medication they are taking. In case of medical concerns, the User is advised to consult their treating physician before starting any nutrition program.

The Provider bears no liability for any adverse effects that may arise from the User's failure to observe the above.

9. Purchases & Payments

Prices for Services and Products are listed on the Website in euros (€) and include applicable VAT, unless otherwise stated.

The Provider reserves the right to modify prices at any time, without affecting already completed purchases.

Payments are processed through the Stripe platform, which complies with PCI-DSS security standards. The Provider does not store or process credit/debit card details.

Upon completion of the purchase, the User receives a confirmation email and, where applicable, a legal receipt or invoice.

For digital product purchases, the User acknowledges and accepts that delivery is immediate via download or access to digital content.

10. Cancellation & Refund Policy

For Services (nutrition sessions): Cancellation of a scheduled session must be communicated at least 24 hours before the scheduled time. In case of late cancellation or no-show, the Provider reserves the right to treat the session as completed and not issue a refund.

For Digital Products: Due to the nature of digital products (immediate access/download), no right of withdrawal or refund is provided after delivery of the digital content, in accordance with Article 16(m) of Directive 2011/83/EU on consumer rights (exception to the right of withdrawal for digital content not supplied on a tangible medium).

For Physical Products: The User has a right of withdrawal within 14 calendar days from receipt, in accordance with Directive 2011/83/EU. The product must be returned in its original condition, unused, and in its original packaging. Return shipping costs are borne by the User. Products that have been unsealed and cannot be returned for hygiene reasons are excluded.

Refunds are processed within 14 business days from approval of the request, using the same payment method used for the purchase.

11. Digital Products

Digital products (ebooks, nutrition programs, guides) are provided exclusively for the personal use of the purchaser.

Reproduction, redistribution, resale, or public communication of digital products, in whole or in part, without the Provider's written permission is expressly prohibited.

The Provider bears no liability for technical download issues caused by the User's connection or equipment.

Access to digital content may be granted for a specific period or indefinitely, as stated in the description of each product.

12. Promotions & Offers

The Provider may run promotions, discount periods, and marketing campaigns, which are governed by specific terms stated in each offer.

Offers are valid for a specific period and while supplies last. The Provider reserves the right to withdraw or modify offers at any time.

Combining multiple offers or discounts is not permitted unless explicitly stated.

Promotional codes are personal and non-transferable. The Provider reserves the right to cancel orders placed through irregular use of promo codes.

13. Data Protection & Privacy

The processing of Users' personal data is governed by the Privacy Policy, available at /privacy-policy, and complies with the General Data Protection Regulation (GDPR — EU 2016/679) and applicable national laws.

By using the Website, the User consents to the processing of their data in accordance with the Privacy Policy.

For payment processing through Stripe, Stripe's Terms of Service and Privacy Policy (stripe.com) additionally apply.

14. Cookies

The Website uses cookies and similar technologies in accordance with the Cookie Policy, available at /cookie-policy.

The User may manage cookie preferences via the consent management tool (consent banner) displayed upon first visit.

15. Third-Party Services

The Website uses third-party services, including but not limited to: Stripe (payment processing), Supabase (file storage), Resend (email delivery), Upstash (rate limiting), and web analytics services.

The Provider bears no liability for the availability, security, or any damage that may arise from the use of these third-party services. Their use is subject to the respective terms of each provider.

16. Limitation of Liability

The Provider makes every effort to ensure the accuracy and currency of the Website content; however, no guarantee is given as to its completeness, accuracy, or timeliness.

The Provider shall not be liable for: (a) any direct, indirect, incidental, or consequential damages that may arise from the use or inability to use the Website; (b) technical issues, service interruptions, or data loss; (c) the content of external links that may appear on the Website; (d) any health issues that may arise from applying nutritional advice without prior medical consultation.

The total liability of the Provider for any claim arising from the use of the Website or the purchase of Services/Products is limited to the amount paid by the User for the specific transaction, to the extent permitted by applicable law.

Nothing in these Terms excludes or limits the Provider's liability for fraud, gross negligence, death or personal injury, or any other liability that cannot be excluded or limited under applicable law.

The above limitations apply to the maximum extent permitted by applicable law and do not affect the consumer's statutory rights under Greek and EU consumer protection legislation.

17. Force Majeure

The Provider shall not be liable for delays or failure to perform obligations due to force majeure events, including but not limited to natural disasters, war, terrorist acts, pandemics, government restrictions, power or telecommunications outages, and cyberattacks.

18. Modifications to Terms

The Provider reserves the right to unilaterally modify these Terms at any time. Modified terms take effect upon their publication on the Website.

Continued use of the Website after modification constitutes acceptance of the new terms. Users are advised to periodically review the Terms for changes.

For material modifications, the Provider will notify registered Users via email, where available.

19. Governing Law & Dispute Resolution

These Terms are governed by Greek law and EU consumer protection law.

For the resolution of any dispute arising from these Terms, the courts of the Provider's registered seat shall have jurisdiction, without prejudice to consumer rights under Regulation (EU) 1215/2012.

The User-consumer also has the right to use the Online Dispute Resolution (ODR) platform of the European Commission: https://ec.europa.eu/consumers/odr.

20. Severability

If any provision of these Terms is held to be invalid or unenforceable by a competent court, that provision shall be severable and shall not affect the validity and enforceability of the remaining provisions.
